You must be at least 18 years old or of age required to enter into legally binding contracts to purchase products and services offered by elgobay.com.
You, your, purchaser, member, user; shal refer to any person or entity who use elgobay.com and or purchase products or services.
We, us, our, elgobay, elgobay.com; shall refer to elgobay.com, who offer products and services.
Your use of our website constitute your acceptance and agreement to our conditions of use and purchase and our privacy policy and our shipping and return policy.
Any and all links, urls or other references herein, shall be incorporated as part of this conditions of use and purchase.
We reserve the right to change these terms, conditions and product prices, from time to time, without notice to you. Please accept these conditions before use or purchase, on every occassion.

Tax and Other Liability

You are solely responsible for any tax (sales, use, tangable, intangable) duties or other fees, associated with any and all purchases from us, regardless of your location.

Placing Orders and Payment

Your are responsible to pay in full, for all orders placed from your account and accept the delivery of your order. You agree to be responsible to pay a $25 returned check fee or the lesser fee allowed by State Law; for any check that you make to us, which is returned to us unpaid. You agree to be also liable to us for any and all fees, including but not limited to court cost and attorney fees, we incur in collecting or processing your payment, for any order placed from your account.
Do not place an order if you do not intend to or cannot afford to pay. Your account will be permanently banned if you do not pay for any orders placed, within 7 days or you use fraudulent means to pay for your order. Fraud is not tolorated here and we will cooperate fully with law enforcement to identy and prosecute those who commit fraud. We do not ship orders until we receive and successfully process full payments.

Discount and Cashback Offers
You cannot combine discounts and cashbacks. Discounts and cashbacks are offered, one per order, only. Discounts and cashbacks, not offered directly by ElgoBay.com, are not the responsibility of ElgoBay.com and ElgoBay.com disclaims any liability for such offers.

Product Warranty

ElgoBay does not warranty any product we sell. Warranty on "new" products are offered by the manufacturer (manufacturers warranty). Unlocking and or custom conversion may void manufacturer warranty. Any warranty on "Refurbished" products are 30-90 days, limited time warranty. Warranty information is usually enclosed with your product, along with the manufacturer's contact information. You are solely responsible for registering your product with the manufacturer to activate warranty. Some manufacturers require registration within 30 days of your purchase.
Extended warranty service plans may available for purchase and are third party services.
Plasma and LCD TVs are not eligible for return. Most TV or Monitors, 30" or projections products and Samsung TV's 14" or larger do not qualify under normal Return Policy. Contact Samsung @ 1-800-SAMSUNG or the appropriate manufacturer for service. Most TV's or Monitors 30" or larger and projection products require in-field service repairs under manufacturer's warranty. These products are not eligible for return. Please contact the appropriate manufacturer for troubleshooting and or repair service.
There is no manufacturers warranty on any cellular phones we sell.

Shipping Policy


Any order cancellation must be received prior to shipping. Orders cannot be canceled after shipping.
We will notify you via email, once your order has been shipped. We ship products worldwide, subject to full payment, embargos, tarriffs and treaties. We will ship your purchase within 24 hours (during business days) of cleared payment (3-5 business days) from you. Business days are Monday through Friday, except Holidays, USA.
Products (except Clearance category) are shipped from the warehouse and may take up to 2 business days to ship. Unlocked iPhones are custom orders and may require up to 7 days to ship. Most products are shipped FedEx to the continental USA and FedEx economy or priority International.
USPS Priority mail and Express mail, may not be available for most products, unless specifically listed as available with the product.

You the purchaser are responsible for the cost of shipping your purchased item(s), including return shipping, unless we offer free shipping, which will be on promotion only. Free shipping does not apply to return item, unless a return label has been issue to you.
Purchaser is also reponsible for all costs, duties, tarriffs and tax associated with their purchase.
Shipping costs are calculated based on weight, packaging, destination and carrier. We reserve the right to which carriers we choose and we make those carriers and similar service, available to you. We will ship your item(s) to the billing address presented with your payment, unless you notified us otherwise and we approve.
You are responsible for the collection or claim of your shipment upon arrival. If your purchase/shipment is returned to us unclaimed, you agree to pay for re-shipment to you. You are not entitled to any refund simply because your purchase/shipment was returned to us. We will hold your purchase/shipment for 30 days after it has been returned to us, after which it shall be considered abondoned, forfeited; without recourse to you.

Returns and Refund Policy

We will accept returns up to 30 days from the delivery date, Except for items purchased from the "Clearance" category and Special or custom orders; which has a limited 14 days, from purchase date; for return on missing or non working items only.
Special orders (items not stocked or require custom work, example; iPhones) require approval for any order cancellation request, prior to shipping. No refund for custom or special orders, return for repairs only. Intangable items (items digitally delivered) MUST be returned within 24 hours of purchase, unused, undisclosed, uncompromised and valid for resale. We may not accept return of household electronics, electronic media; CD, DVD, Video Games, etc. Electronics are covered under their manufacturers warranty and all claims and liability lies with the manufacturer.

Due to the volunerability of the iPhone operating system; we do not accept returns for refund on iPhones. Return of iPhones is limited to damaged during transit ,or operating system failure within 30 days of receipt. In such cases we will accept return for exchange or repair. An exchange will be given if the item cannot be repaired.

Items Not Covered by this Return Policy:
TVs: If the item is defective the customer will need to contact the Manufacturer directly. If the item is unwanted and the item packaging was not open, this item may be returned to us per our "Unwanted Returns" section.
Gaming (includes Brand New consoles and games for all different types of systems): All of the gaming comes with Manufacturer's warranty unless specified otherwise in the description section of the item. If the item is defective customer will need to contact Manufacturer. If the item is unwanted and was not open, this item may be returned to us per our "Unwanted Returns" section.
Personal Care Items: If the item is defective the customer will need to contact the Manufacturer directly. If the item is unwanted and was not open, this item may be returned to us per our "Unwanted Returns" section.
Cellular Phones: Phones returned due to frequency issues are subject to approval and a 30% restocking fee. All phones intended for use with carriers other than GSM networks are marked accordingly. As the majority of phones we offer are international models, and are not assigned to one specific carrier, unless marked otherwise, the GSM phones can be used on any GSM network: Cingular, Tmobile, AT&T, etc… However for best service from your cellular phone, the frequency regulations must be observed.
All cellular phones are sold as is and do not include any manufacturer warranty.
Dead On Arrival cell phones: Return of any Dead On Arrival cell phone, must be reported to us within 7 business days of the receipt of the merchandise. This type of return may be accepted, only for exchange without exception.

You MUST notify us prior to returning any and all purchase and we MUST approve and issue a Return Merchandise Authorization number (RMA#). Return Merchandise Authorization number is valid for 14 days from the date of issue. We must receive all return item within 14 days from the date the RMA# was issued. Please do not ship any return item to us after the 14 days allowed for Return Merchandise Authorization. You will not be refunded for returned item after this 14 days time-frame.
The returned item(s) MUST be in original condition, packaging and undamaged by you. If your returned item is not in original condition or used, you will be charged a 30% repackaging fee, which will be deducted from your refund amount.

Defective Items: A customer must return merchandise at their expense within 30 days from the date of delivery with prior Return Merchandise Authorization number. If an exchange is not requested at the issuing time of the RMA, a full refund in store credit will be applied once merchandise is returned back to the warehouse.

Unwanted Returns: Unwanted product returns will be subject to a 30% restocking fee and must have a Return Merchandise Authorization number (RMA#). Merchandise must be in the original, unused, unopened condition.

Refused Delivery: Returns falling under this category will be treated as “Unwanted Returns”, consequently they will be subject to a 30% restocking fee. The customer will also be responsible for the return shipping cost incurred by the action of refusing or avoiding the delivery or acceptance of your order.
If you receive a product that is damaged (when received) in transit, follow these instructions:
1. Note any damages on the receipt.
2. Refuse the shipment (if possible) so that it is returned for freight claim processing. For partially damaged shipments or concealed damage, note damage on receipt and refuse damaged item if possible.
3. Contact us and the carrier immediately.

DOA cell phones: For the return of any Dead On Arrival cell phone, we must be notified within 7 business days of the receipt of the merchandise. This type of return is only for exchange for similar without exception.

Refund
Cancelled orders are automatically refunded.
If we cancel your order because your shipping and billing address does not match and you place the order again with the same information, you will be charged a $1 processing fee for each subsequent refund after the initial refund.
We will refund you for returned item(s) within 14 days from the date we receive your return. Refund will be given in the same method payment was received. Items purchased from the "Clearance" category are limited to exchange only, within 14 days. You are solely responsible for return shipment costs and any other cost associated with returning your purchase. We are not responsible for lost, stolen, missing returned item(s). We are only obligated to refund you for return if;
(1) You request a refund and qualified as outlined herein. Otherwise you will receive an exchange or store credit in the form of a Gift Certificate.
(2) We receive the returned product within 14 days of RMA issue date
(3) If the product was damaged during transit or before you receive it, in which case you agree to notify us and the carrier immediately and no later than 24 hours of receipt.
Under no circumstances can we be liable to you for any amount more than the amount you paid to us.
